Privacy Policy

 

The personal data that is requested in the course of your registration on the website www.lasso.pt for subscription to our newsletter, to request information or in the scope of the use of our services or products, will be treated in accordance with the rules defined in this Privacy Policy.

 

A. Data controller and mandatory collection

This privacy notice aims to inform you of the automated processing activities of  personal data carried out by Sopsa Eco Innovation, S.A., a legal person with the NIPC and NIF 502 832 266 and headquarters at Parque Industrial da Ermida, Rua António Joaquim Campos Monteiro, number 800, in Santo Tirso (hereinafter referred to as SOPSA) about the personal data provided,  for the purposes described below.

Unless expressly stated otherwise, it is essential that you provide us with the personal data requested in order to process your registration and provide you with our newsletter, the requested information or our products and services. If we are unable to collect such personal data, there is a possibility that we may be unable to process your registration or provide you with our newsletter, the requested information or our products and services. Personal data will be used exclusively for the purposes expressly described in this Clause.

By accepting this privacy policy, you warrant and represent that the personal data you have provided to us belongs to you and that they are true, accurate and up to date. You must inform us immediately of any changes to your personal data in accordance with the procedure set out in section C. Rights of the data subject.

 

B. Legal basis and purposes of data processing operations

Your personal data will be processed on the basis of the grounds set out below and for the purposes respectively described:

          I. Based on the basis “Performance of a contract or for pre-contractual procedures“, your data will be processed to:

a. Management of your request to register as a customer and to activate your subscription, which requires verification of your identity and collection of your contact details. If an incident occurs during the registration process, we may contact you during the next 48 hours to complete your registration;
b. Sending communications related to the aforementioned products and services, sending information requested through our contact forms, handling questions and complaints;
c. As a user of SOPSA’s products or services, and as a result of the contractual relationship established with SOPSA, you will receive communications, which may be sent by electronic means, regarding new products, new technologies, innovative projects, opportunities, events, negotiated advantages and relevant information about products and services made available by the company. You can also receive information about fairs and events in which SOPSA participates and invitations to them.
c. You may receive surveys for opinion studies as a consumer of products and/or services offered, so that SOPSA can assess the degree of consumer satisfaction with the product and/or services that correspond to it in each case, and, in view of the results obtained, prepare and publish reports and articles that are of interest to its customers, in particular, and consumers in general.

 

          II. Based on the legal basis “Legitimate interest of the data controller”, your data will be processed for the following purposes:

a. Verify your identity for fraud prevention purposes;
b. Conduct satisfaction surveys about the products and services to which you have access as a user;
c. Allow us to learn more about you as a subscriber and/or user free of charge, including setting the preferences you have declared as a user of our services, resulting from the analysis of your use of our products and services, how you prefer to be contacted and other aspects related to the development of the contractual relationship. This profile is not carried out on the basis of an automated decision, it is only intended to provide you with a personalized service that meets your interests and preferences, but is not intended to anticipate your future behaviors or to anticipate your interests or capabilities. These activities do not involve the automated processing of data with legal effects on you or the exhaustive evaluation of aspects related to your personality in an automated way. Our profiling activity is always carried out in a moderate manner, with a scrupulous balance between your right to privacy and the mission of SOPSA as an organization that develops and manufactures innovative solutions for the management of municipal solid waste. To this end, SOPSA has devised mechanisms to protect your rights and prevent potentially abusive activities. You may, at any time, object to this processing through the mechanism set out in section C. Rights of the data subject.

 

          III. Based on the consent of its owner, your data will be processed for the following purposes:

a. Inclusion in the mailing list, for the purpose of sending the newsletter.
b. You may receive communications, which may be sent electronically, regarding new products, new technologies, innovative projects, opportunities, events, negotiated advantages and relevant information about products and services made available by the company. You can also receive information about fairs and events in which SOPSA participates and invitations to them.
c. You may receive surveys for opinion studies as a consumer of products and/or services offered, so that SOPSA can assess the degree of consumer satisfaction with the product and/or services that correspond to it in each case, and, in view of the results obtained, prepare and publish reports and articles that are of interest to its customers, in particular, and consumers in general.

 

C. Rights of the data subject

Where we process your personal data on the basis of your consent, you have the right to withdraw that consent at any time. In accordance with the data protection legislation in force, you may not only withdraw your consent but also have the right of access, rectification, erasure, limitation, opposition and portability of the data, by sending us an e-mail  to geral@sopsa.pt, or a letter addressed to SOPSA ECO INNOVATION, S.A. (Ermida Industrial Park, Rua António Joaquim Campos Monteiro, 800, 4780-165 SANTA CRISTINA DO COUTO).

In order to be able to provide you with the consultation of your personal data, and in order to avoid the delivery of your data to an unauthorized third party, SOPSA may require proof of your identification by displaying your updated identification document.

We ask you to also bear in mind that the withdrawal of consent will not affect the lawfulness of the processing prior to the revocation.

If you believe that your rights over personal data have been infringed, you have the right to lodge a complaint with the National Data Protection Commission.

 

D. Recipients

In accordance with the terms described in section B., SOPSA does not transfer your data to third parties.

Notwithstanding the foregoing, SOPSA works with certain service providers that develop their activity in the following sectors: legal advice, communication advice, technological service providers, computer service providers, security companies, instant messaging service providers, infrastructure management and maintenance companies, among others. Within the scope and for the exercise of this subcontracted provision of services, these “subcontractors” may have access to your personal data, but only process such data on behalf of and on behalf of SOPSA, always and only in accordance with the express instructions given to you by SOPSA and as a result of the contract concluded between the latter and those service providers.

SOPSA follows strict criteria in the selection of service providers in order to comply with its data protection obligations, committing to sign with them a data processing agreement, which includes, among others, the following obligations: apply appropriate technical and organizational measures; process personal data for the agreed purposes and responding exclusively to the documented instructions of SOPSA; and delete or return the data to SOPSA upon completion of the services.

When data processing is done  in different countries, the competent Data Protection Authority (DPA) – which will be  the lead authority in  its relations with other competent DPAs in the EU – is the National Data Protection Commission. The principal place of business shall be that of the registered office, unless decisions on the purposes and means of the processing of personal data are taken in another establishment and that establishment has the power to enforce those decisions.

Where data processing is necessary to comply with a legal obligation under the national law of another EU Member State, only the DPA of that EU Member State is competent.

 

E. Shelf life

For the strict purpose of ensuring pre-contractual procedures, if the registration process is not completed, your data will be kept for 48 hours after the start of the process, after which it will be removed from any database under the responsibility of SOPSA.

If the registration process is successfully completed, your personal data will be kept throughout your contractual relationship with SOPSA. Once the same has been terminated, notwithstanding the provisions of the following paragraph, your personal data will be deleted at the moment when all the actions necessary to administer and conclude any obligation that remains between the parties have been carried out, and all the necessary administrative procedures will be carried out during this period.

Your personal data will be stored, in a blocked form, to meet the responsibilities resulting from the contractual relationship and other legal obligations of SOPSA. In such cases, SOPSA guarantees that it will not process your personal data, unless it is strictly necessary for the formulation, exercise and defense of claims, or when required by the Public Administration, Judges and Courts, during the limitation period of your rights or legal obligations.

 

F. Cookies

Cookies are proof of connection, they are small information files that can be implemented on your computer when you browse the internet.

Unlike other similar devices, cookies are a legitimate and useful tool because they allow the website to remember you and your preferences, eliminating, for example, the need to repeatedly enter the same information.

When you access www.sopsa.pt browsing cookies may be placed on your computer and information relating to the navigation of the user’s computer on the site such as the pages consulted, the date and time of consultation may be recorded. This registration will only be made if you consent.

If you do not consent, you can continue to consult the site, although the refusal may prevent access to certain features, pages and / or spaces of the site to which you would normally have access.

In any case, the user has the possibility to deactivate, at any time, the entire installation of cookies by adapting, in consequence, the configuration of his internet browser.
